Terms of Service — Fifth Gear Auto Parts

By accessing or placing an order on fifthgearautoparts.com, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use this site.

1. About Fifth Gear Auto Parts
Fifth Gear Auto Parts is an online retailer of used OEM auto parts operating at reclaimparts.com. We operate an online store selling used OEM automotive parts to customers in the contiguous United States. All parts are sourced from US-based salvage vehicles and shipped from our warehouse network across the US.

We sell exclusively to customers in the 48 contiguous United States. We do not ship to Alaska, Hawaii, Puerto Rico, Canada, or other US territories or international destinations.

2. Eligibility
By using this site, you confirm that you are at least 18 years of age and are legally capable of entering into a binding contract. Orders placed on this site constitute a commercial transaction and are subject to these terms.

3. Product Listings & Condition
All parts sold by Fifth Gear Auto Parts are used OEM (Original Equipment Manufacturer) parts unless explicitly stated otherwise. Parts are sourced from salvage vehicles and may show normal signs of wear consistent with prior use and vehicle age.

Product listings include fitment information for reference only. It is the buyer's sole responsibility to verify compatibility with their specific vehicle — including year, make, model, trim, engine, and OEM part number — before placing an order. We strongly recommend confirming fitment using your VIN before purchasing. Fifth Gear Auto Parts is not liable for parts ordered for an incorrect fitment.

All parts are inspected prior to listing. Cosmetic wear, minor surface marks, or age-related patina are normal characteristics of used OEM parts and do not constitute defects. Photos on listings are for reference only and may not represent the exact item shipped.

4. Pricing & Payment
All prices are displayed in US Dollars (USD) and are subject to change without notice. The price charged is the price shown at the time of order placement.

We accept all major payment methods displayed at checkout. By submitting payment, you authorize Fifth Gear Auto Parts to charge the full order amount including any applicable taxes or fees.

We reserve the right to cancel any order where a pricing error has occurred. In such cases, we will notify you promptly and issue a full refund.

5. Order Acceptance
Placing an order does not constitute a guaranteed contract of sale. We reserve the right to refuse or cancel any order for reasons including but not limited to:

  • The part is no longer available or has already been sold
  • Errors in product description or pricing
  • Suspected fraudulent or unauthorized transactions
  • Inability to verify payment or shipping information

If your order is cancelled, you will receive a full refund within 3–5 business days.

6. Shipping
Orders are processed within 1–3 business days and shipped via UPS. Shipping is free on all orders to the 48 contiguous US states. Estimated delivery is 3–7 business days after shipment. Orders may ship from multiple warehouse locations — if so, you will receive individual tracking numbers for each shipment at no additional cost. Full details are available in our Shipping Policy.

7. Returns & Refunds
Returns are accepted within 15 days of confirmed delivery, subject to the conditions in our Return & Refund Policy. A 30% restocking fee applies to all returns, covering labor costs of pulling and preparing parts from our vehicle inventory, as well as inspection, re-testing, and relisting. The restocking fee is waived only where we shipped the wrong item or the part arrived defective. Return authorization is required before shipping any item back. Return shipping costs are the responsibility of the buyer in all cases.

8. Limitation of Liability
Fifth Gear Auto Parts provides used OEM parts as-is. We are not liable for:

  • Vehicle damage, personal injury, or consequential losses arising from the installation or use of any part purchased from us
  • Labor costs associated with the installation or removal of any part
  • Incompatibility resulting from incorrect fitment information provided by the buyer
  • Delays in shipping caused by carriers, weather, or circumstances outside our control

Our maximum liability in any circumstance is limited to the purchase price of the part in question.

9. Warranty Disclaimer
Used OEM parts are sold without any implied warranty of merchantability or fitness for a particular purpose beyond what is expressly stated in our product listings. Any warranty offered is limited to what is described on the product listing page and does not extend to consequential or incidental damages.

10. Intellectual Property
All content on this website — including text, images, logos, product descriptions, and design — is the property of Fifth Gear Auto Parts. You may not reproduce, redistribute, or use any content from this site without prior written permission.

Vehicle manufacturer names and logos referenced in product listings are trademarks of their respective owners and are used solely for fitment identification purposes. Fifth Gear Auto Parts has no affiliation with any vehicle manufacturer.

11. Acceptable Use
You agree not to use this site to:

  • Submit false, misleading, or fraudulent orders
  • Scrape, harvest, or systematically extract data from the site
  • Attempt to gain unauthorized access to any part of the site or its systems
  • Use the site in any way that violates applicable laws or regulations

12. Governing Law
These Terms of Service are governed by the laws of State of Texas, United States. Any disputes arising from these terms or your use of this site shall be subject to the exclusive jurisdiction of the courts of Texas.
